Loyalty Program Terms:
Loyalty status accumulation is strictly personal and linked to a single unique customer account. The € 500 threshold is calculated based on effectively paid and kept products (excluding shipping fees). Cancelled pre-orders or returned items will be deducted from the total accumulated balance. The 1% discount is automatically applied starting from the first order placed after reaching the threshold and cannot be claimed retroactively on previously completed orders.
General conditions
TERMS AND CONDITIONS (DIECAST MODELS)
Article 1. Applicability and Definitions
1.1. These Terms and Conditions apply to all offers, agreements, and deliveries of products via the online store of [Your Webshop Name], established in Belgium.
1.2. Definitions:
- Product: Diecast airplane models in scales such as 1:200 and 1:400, including their specific manufacturer packaging.
- Consumer: Any natural person acting for purposes outside their trade, business, craft, or profession.
Article 2. Product Specifications and Manufacturing Tolerances
2.1. The Consumer acknowledges that diecast airplane models (specifically in scales 1:200 and 1:400) are adult collector's items and not children's toys.
2.2. Due to the precision and partial hand-assembly involved in the manufacturing process of these models, minor factory variations—including but not limited to microscopic paint or tampo-print imperfections, minimal glue residue, or slight gaps between parts—do not constitute a product defect or non-conformity.
2.3. The Consumer is responsible for selecting the correct scale (1:200 vs. 1:400). Returns based on the argument that a model is "larger or smaller than expected" will be treated as a standard return under the Right of Withdrawal (Article 4).
Article 3. Pre-Orders and Estimated Release Dates
3.1. Products offered for pre-order are subject to manufacturer production schedules. All release dates communicated on the webshop are estimates provided by the manufacturers (e.g., GeminiJets, JC Wings, Herpa) and are subject to delays beyond the control of [Your Webshop Name].
3.2. WinGs On Scale cannot be held liable for any damages or frustration resulting from manufacturer delays or cancellations of pre-ordered items.
Article 4. Right of Withdrawal and Diminished Value (Returns)
4.1. Pursuant to Book VI of the Belgian Code of Economic Law, EU Consumers have the right to withdraw from the contract within 14 calendar days from the day of delivery without giving any reason.
4.2. Collector Packaging Policy: The original manufacturer's box, plastic blister packs, inserts, and protective foams are an integral part of the collector's item value.
4.3. If the Consumer exercises their right of withdrawal, the product must be returned in its original, unaltered, and undamaged condition, including all original packaging.
4.4. Diminished Value Charges:
- If the manufacturer's box is damaged, taped, written upon, or used directly as the shipping box (without external protective wrapping), a diminished value fee of 50% to 100% of the purchase price will be deducted from the refund.
- If a model shows signs of assembly (such as being placed on its display stand, or changing magnetic landing gears) or handling beyond what is necessary to establish the nature and characteristics of the model, a diminished value fee up to the full purchase price will apply.
4.5. Unless otherwise stated, the costs of returning the goods are borne entirely by the Consumer.
Article 5. Transport, Damage, and Detached Parts
5.1. Risk of loss or damage to the goods passes to the Consumer upon physical delivery of the package to the Consumer or a designated third party.
5.2. Fragile Components: Diecast models feature highly delicate, microscopic parts (such as antennas, pitot tubes, and winglets). Due to vibrations during international transport, it is possible for these small parts to become detached inside the packaging.
5.3. Detached Parts Policy: The clean detachment of a small, undamaged part (e.g., a loose antenna or wheel) that can be easily reinserted or secured with a tiny drop of model glue does not constitute a manufacturing defect or transport damage. Such occurrences do not automatically entitle the Consumer to a free return or replacement.
5.4. Reporting Damage: Any structural damage (e.g., broken wings, snapped fuselages) must be reported to [Your Webshop Name] via email within 48 hours of delivery, accompanied by clear photographic evidence of both the model and the shipping box.
Article 6. Applicable Law and Dispute Resolution
6.1. All agreements and disputes arising from purchases on this webshop are governed exclusively by Belgian law.
6.2. In the event of a dispute, the courts of the judicial district where [Your Webshop Name] is registered shall have jurisdiction, without prejudice to consumer protection laws that grant jurisdiction to the courts of the consumer's domicile.
6.3. European Consumers can also submit disputes to the European Online Dispute Resolution (ODR) platform via: europa.eu.
